En otras palabras, hay que tomar como punto de partida al hombre( real, que no e'iste como tal sino dentro de las condiciones históricas y sociales que lo constituyen. irada as", la refle'ión debe tomar como base los valores y la jerarqu"a entre los mismos que establece dicha comunidad, porque tales valores y su jerarqui#ación no pueden considerarse como el resultado del a#ar, sino que llevan en su interior la rique#a acumulada por largas y dolorosas e'periencias. Las costumbres y valores de una sociedad dada poseen, para esta manera de entender las cosas, lo que en derecho cabr"a llamar el statuspossessionis, es decir, la presunción de su derecho. -ales costumbres deben ser consideradas como racionales y correctas, mientras no se demuestre lo contrario. El peso de la prueba recae, entonces, sobre quien pretenda cambiarlas o subvertirlas.$ K
