Equipoise Doctrine

Equipoise doctrine = is the rule which states that when the evidence of the prosecution and the defense are so evenly balanced the appreciation of such evidence calls for tilting of the scales in favor of the accused. Impossible Crime = criminal liability shall be incurred, inter alia , by any person performing an act which would be an offense against persons or property, were it not for the inherent impossibility of its accomplishment or an account of the employment of inadequate or ineffectual means. When the person intending to commit an offense has already performed the acts for the execution of the same but nevertheless the crime was not produced by reason of the fact that the act intended was by its nature one of impossible accomplishment or because the means employed by such person are essentially inadequate to produce the result desired by him, the court, having in mind the social danger and the degree of criminality shown by the offender, shall impose upon him the penalty of arresto mayor  or  or a fine from PhP200 to PhP500. Command Responsibility Rule = Commanders and other superiors are criminally responsible for war crimes committed by their subordinates if they knew, or had reason to know, that the subordinates were about to commit or were committing s uch crimes and did not take all necessary and reasonable measures in their power to prevent their commis sion, or if such crimes ha d been committed, to punish the persons responsible.
