The Competition Appellate Tribunal Tribunal is a statutory organization established under the provisions of the Competition Act, 2002 to hear and dispose of appeals against any direction issued or decision made or order passed by the Competition Commission of India under sub-sections (2 and (! of section 2!, section 2", section 2#, section $%, section $2, section $$, section $#, section $&, section '$, section '$A, section '', section ' or section '! of the Competition Act, 2002) The Appellate Tribunal shall also ad*udicate on claim for compensation that may arise from the findings of the Competition Commission of India or the orders of the Appellate Tribunal in an appeal against any findings of the Competition Commission of India or under section '2A or under sub-section (2 of section $+ of the Act and pass orders for the recovery of compensation under section $ of the Act) The Central overnment has set up the Appellate Tribunal on %th .ay, 200& having its /eaduarter at e1 elhi) /on3ble r) 4ustice Ari*it 5asayat, former 4udge of 6upreme Court, has been appointed as the 7irst Chairperson of the Appellate Tribunal) 8esides, the Chairperson, the Appellate Tribunal shall consist of not more than t1o .embers to be appointed by the Central overnment) The Chairperson of the Appellate Tribunal shall be a person, 1ho is, or has been a 4udge of the 6upreme Court or the Chief 4ustice of a /igh Court) A .ember of the Appellate Tribunal shall be a person of ability, ability, integrity and standing standing having having special special 9no1ledge 9no1ledge of, and profession professional al e:perience e:perience of not less than t1enty-five years in, competition matters, including competition la1 and policy, international trade, trade, economics, economics, business, business, commerce, commerce, la1, la1, finance, finance, accountancy accountancy,, management management,, industry industry,, public public affairs, administration or in any other matter 1hich in the opinion of the Central overnment, may be useful to the Appellate Tribunal) The Chairperson or a .ember of the Appellate Tribunal shall hold office for a term of five years and shall be eligible for re-appointment) 5rovided that no Chairperson or other .ember of the Appellate Tribunal shall hold office after he has attained the age of si:ty-eight years or si:ty-five years respectively) ;very appeal shall be filed 1ithin a period of !0 days from the date on 1hich a copy of the direction or decision or order made by the Competition Commission of India is received and it shall be in the prescribed form and be accompanied by the prescribed fees) The Appellate Tribunal Tribunal may entertain an appeal after the e:piry of the period of !0 days if it is satisfied that there 1as sufficient cause for not filing it 1ithin that period) The Appellate Tribunal Tribunal shall not be bound b y the procedure laid do1n in the Code of Civil 5rocedure, %&0# ( of %&0#, but shall be guided by the principles of natural *ustice and, sub*ect to the other provisions of this Act and of any rules made by the Central overnment) The Appellate Appellate Tribunal shall have, for the purposes of discharging its functions under the Act, the same po1ers as are vested in a civil court under the Code of Civil 5rocedure, %&0# ( of %&0#) ;very order made by the Appellate Tribunal shall be enforced by it in the same manner as if it 1ere a decree made by a court in a suit pending therein) If any person contravenes, 1ithout any reasonable ground, any order order of the Appellate Tribunal, he shall be liable for a penalt y of not e:ceeding rupees one crore or i mprisonment for a term up to three years or 1ith both as the Chief .etropolitan .agistrate, elhi may deem fit)
