CHAPITRE 1 Objet et champs d’application ARTICLE 1 : Des parties contractantes. contractantes . La présente convention collective est conclue entre la société de l’eau et de l’assainissement de Constantine par abréviation « SPA SEACO » et les représentants des travailleurs de la dite société. ARTICLE 2 : Du champ d’application. La présente convention collective s’applique sur l’ensemble des lieux de travail de la société et à l’ensemble des agents salariés de la société. Est considéré comme agent salarié de la société au titre de la présente convention toute personne liée à cette dernière par une relation de travail écrite ou non écrite et à durée déterminée ou à durée indéterminée à plein plein temps ou à temps temps partiel et qui fournit un travail travail manuel ou intellectuel, à l’exception de ceux cités à l’article l’ article 3 ci-dessous. ARTICLE 3 : Du personnel non concerné. Ne sont pas concernés par les dispositions de cette convention les personnels régis par les statuts et autres dispositions légales spécifique notamment :

Les conditions de travail des catégories précitées sont déterminées par des contrats spécifiques. ARTICLE 4 : De la conformité à la loi. La présente convention collective est établie conformément à la législation en vigueur, et notamment à 1990 , relative aux relations de travail la disposition de la loi 90-11 du 21 avril 1990 , t ravail modifiée et complétée. ARTICLE 5 : Du contenu. La présente convention est établie en conformité avec la loi 90-11 relative aux relations de travail modifiée et complétée. Elle traite des conditions de travail et définit les droits et obligation des travailleurs. ARTICLE 6 : De la finalité du travail. Le travail est la condition essentielle du développement de la société. C’est la source par laquelle le travailleur assure ses moyens d’existence.

CHAPITRE 2 Durée – Révision – Dénonciation – Exécution ARTICLE 7 : De la durée. durée . La présente convention est conclue pour une durée de trois années à compter du 01/07/2009. ARTICLE 8 : De la révision. Les dispositions de la présente convention ainsi que celles de ses annexes sont modifiées de droit dans les conditions suivantes :
- Lorsque les dispositions législatives et réglementaires en vigueur sont modifiées et/ou abrogées. -
En cas de promulgation de nouvelles dispositions législatives et réglementaires . réglementaires .
ARTICLE 9 : De la Dénonciation. La convention collective peut être dénoncée en partie ou en totalité par l’une des parties signataires. La dénonciation ne peut intervenir dans les douze ( 12) mois qui suivent son enregistrement auprès de l’inspection du travail et du greffe du tribunal territorialement compétent. - La dénonciation dénonciation est signifiée par lettre recommandée recommandée à l’autre partie signataire signataire avec copie à l’inspection du travail qui a enregistré enregistré ladite convention convention et la dépose auprès du greffe du tribunal territorialement compétent. - La dénonciation est acceptée acceptée à condition qu’elle soit accompagnée accompagnée d’un rapport rapport explicite et de la proposition de rédaction nouvelle concernant les dispositions dénoncées. - La dénonciation totale ou partielle entraine l’obligation par par la commission paritaire paritaire de négociation d’engager de nouvelles négociations dans les trente ( 30 ( 30)) jours pour examiner les modifications proposées. - La dénonciation de la convention ne peut avoir d’effet sur les contrats de travail antérieurement conclus qui demeurent demeurent régis par les dispositions dispositions en vigueur vigueur jusqu’à conclusion d’une nouvelle convention collective. Dans le cas de dénonciation, la présente convention collective reste en vigueur jusqu’à la signature et l’enregistrement l’enregistrement de la nouvelle convention. CHAPITRE 3 Interprétation de la convention collective ARTICLE 11 : De la commission paritaire d’interprétation. En cas de difficultés d’interprétation de la convention collective et de ses annexes, une commission paritaire d’interprétation de la convention collective sera réunie à l’initiative de l’une des parties signataires. Cette commission comprend pour chaque partie :

Cinq(05) membres représentants la société désignés par le directeur général. Cinq(05) membres représentants l’organisation syndicale signataires de la convention.
Les membres composants cette commission d’interprétation sont choisis parmi ceux qui ont participé à la négociation de la convention collective. En cas d’accord de la commission, la décision prise s’impose aux parties. En cas de désaccord de la commission persistant, la partie la plus diligente recourt aux procédures légales de conciliation. La commission d’interprétation fixe son siège au niveau niveau de la direction générale générale de la société. La commission d’interprétation élabore et adopte son règlement intérieur. Elle doit se réunir au plus tard dans les quinze ( 15) jours qui suivent sa saisine.
CHAPITRE 4 Exercice du Droit Syndical ARTICLE 12 : De l’adhésion des travailleurs à un syndicat. Les parties signataires de la convention reconnaissent reconnaissent aux travailleurs de la société le droit d’adhérer de façon libre et d’appartenir d’appartenir à un syndicat de leur choix choix en vertu des lois et règlement en vigueur vigueur et aux statuts de(s) organisation(s) syndicale(s).

ARTICLE 15 : De la liberté d’adhésion à un Syndicat. L’employeur, les travailleurs salariés salariés ainsi que leur leur organisation syndicale syndicale signataire de la présente convention, s’engagent s’engagent à ne pas porter atteinte dans la société, à la liberté individuelle d’adhérer ou non à toute organisation syndicale constituée et œuvrant en conformité avec les lois et règlements en vigueur. ARTICLE 16 : Des prérogatives de l’organisation syndicale. Dans le cadre de la législation et de la réglementation en vigueur la ou les organisation(s) syndicale(s) des travailleurs travailleurs salariés représentatives(s) représentatives(s) au sein de la société ont ont les prérogatives suivantes :
- Participer aux négociations et accords collectifs au sein de l’organisme employeur. - Participer à la prévention et aux règlements des conflits collectifs de travail et à l’exercice du droit de grève.
- Tenir des assemblées générales de l’association syndicale sur les lieux de travail ou dans les locaux y attenants en convenance avec l’employeur pendant les heures normales du travail sous réserve qu’elles se tiennent tiennent à l’approche de la fin de journée de travail.
- Informer les collectifs de travailleurs concernés par des publications syndicales ou par voie d’affichage en des lieux appropriés réservés à cet effet et fixés en commun accord entre l’employeur et les représentants représentants des travailleurs. t ravailleurs.

ARTICLE 18 : De l’affichage des communications syndicales. Les communications syndicales affichées ne peuvent traiter que des problèmes socioprofessionnels touchant la société ou la profession, ou intéressant le monde du travail. ARTICLE 19 : De la disposition d’un local. Conformément à l’article 14 de la loi 91-30 la société doit mettre à la disposition de l’organisation syndicale représentative représentative un local lorsque l orsque celle-ci dispose de plus de cent cinquante (150) adhérents. ARTICLE 20 : De la protection des délégués syndicaux. Aucun délégué syndical ne peut faire l’objet de la part de son employeur d’un licenciement, d’une mutation, d’une sanction disciplinaire de quelque nature que ce soit du fait de ses activités syndicales. Les fautes à caractère strictement syndical, sont de la compétence exclusive de l’organisation syndicale. Dans le cadre de leurs activités syndicales, les délégués syndicaux sont soumis aux dispositions de la présente convention collective. ARTICLE 21 : De l’engagement d’une procédure disciplinaire à l’encontre d’un délégué syndical. En cas de manquement manquement aux dispositions de la présente présente convention ou du règlement règlement intérieur par un délégué syndical une procédure disciplinaire peut être engagée à son encontre par l’employeur, l’organisation syndicale concernée préalablement informée. Aucune mesure disciplinaire ne peut être prononcée par l’employeur à l’encontre d’un délégué syndical en violation de la procédure prévue à l’alinéa précèdent. La protection des délégués syndicaux est assurée dans les mêmes conditions une année après l’expiration de leur mandat. ARTICLE 24 : Des facilités prévues par la loi. Les représentants syndicaux nommément désignés par leur organisation syndicale légalement constituée, obtiendront pendant les heures de travail des facilités prévues par la loi. Ils disposent notamment d’un crédit horaire de 10 heures par mois et par délégué pour l’exercice de leur mandat. Les délégués syndicaux peuvent cumuler et répartir entre eux les crédits horaires mensuels qui leur sont accordés. Le temps passé par les délégués syndicaux aux réunions convoquées convoquées par l’employeur ou acceptées par lui n’est pas pris en compte pour le calcul du crédit horaire ci-dessus cité. Lorsque le véhicule personnel est utilisé pour les missions commandées au delà de 50km du lieu habituel de travail le travailleur concerné bénéficie dans ce cas d’une indemnité kilométrique desserte sept(7) DA Le kilomètre parcouru ARTICLE 163 : Prime de caisse La prime de caisse et attribuée aux travailleurs occupant les postes listés dans le tableau ci-dessous Elle est destiné à couvrir essentiellement les risques de déficit d’avoir en caisse. Lorsque l’agent utilise gratuitement les structures d’hébergement et/ou de restauration de la structure d’accueil ou lorsque la structure d’accueil prend en charge totalement les f rais d’hébergement ou de 25% pour le montant correspondant. restauration les indemnités sont ramenées à vingt cinq 25% pour correspondant. La société peut prendre en charge le travailleur en mission si cela s’avère nécessaire ou sur sa demande. Les modalités d’application sont fixées par la réglementation interne. La prime de repas n’est pas cumulable avec l’indemnité de panier . ARTICLE 168 : Indemnité de frais frais de mission à l’étranger Le travailleur appelé à se rendre en mission temporaire à l’étranger ouvre droit aux indemnités des frais de mission conformément à la réglementation en vigueur ARTICLE 169 : Indemnité de formation Il est alloué une indemnité de formation au travailleur admis à suivre une formation dont la durée est mois . supérieure à trois(3) à trois(3) mois. Cette indemnité vise à compenser les pertes éventuelles de rémunération ou autres frais occasionnés au travailleur durant la période de formation. La réglementation interne fixera les modalités et conditions d’application de cet article. ARTICLE 170 : Indemnité d’enseignement Une indemnité d’enseignement est allouée aux travailleurs lorsqu’ils ne sont pas affectés à plein temps dans des taches d’enseignants. Les travailleurs qui assurent des vacations dans le centre de formation perçoivent une indemnité de quatre mille (4000) DA /jour. /jour . Le volume horaire du temps de travail consacré à l’enseignement ne doit pas excéder vingt(20)% du temps de travail. Les modalités d’application de cet article sont déterminées par une réglementation interne. ARTICLE 171 : Indemnité de parrainage. Il est institué une indemnité dite de parrainage dont le montant est fixé à mille(1000) DA/mois destinée à rémunérer rémunérer les parrains parrains des apprentis apprentis et stagiaires en formation formation pratique au sein des des structures de la société, Les modalités et conditions d’attribution de cette indemnité sont fixées par la réglementation interne.

Les modalités d’application de cet article sont définies par une circulaire d’application ARTICLE 173 : Indemnité de congé annuel L’indemnité afférente au congé annuel est égale au douzième de la rémunération totale perçue au cours de l’année de référence ou au titre de l’année précédent le congé. Par rémunération totale perçue on entend : le salaire soumis à cotisation sociales y compris le douzième des primes de transport et de panier .Cette disposition ne s’applique qu’à compter de la date d’intégration à la S P A SEACO. Toutefois l’indemnité de congé ne peut être inferieure au montant de la rémunération qu’aurait perçu le travailleur s’il avait continué à travailler. Une circulaire d’application en définira les modalités pratiquée mise en œuvre de cet article ARTICLE 174 : Personnel temporaire affilié à la CACOBATPH L’Indemnité de congé annuel du personnel affilié à la caisse nationale des congés payés du bâtiment des travaux publique et de l’hydraulique (CACOBATPH) est versée directement par cette dernière aux er travailleurs concernés de la société dés l’ouverture de la compagne des congés payés, soit le 1 juillet, contre remise de certificat de congé ARTICLE 175 : Prime antifraude Il est institué une prime anti-fraude à attribuer à tout travailleur qui décèle effectivement une fraude en matière de branchement d’eau. Par fraude il est entendu toute soustraction ou consommation frauduleuse par piquage illicite ou inversion de compteur, compteur, ou rétablissement rétablissement non réglementaire de façon à fausser la comptabilité comptabilité de l’eau livrée au consommateur. consommateur. Le travailleur étant en positionnement préretraite ne peut bénéficier ni d’avancement vertical (promotion) ni d’avancement horizontal (échelon). Retraite proportionnelle : Lorsque le travailleur émet le vœu de partir en retraite suivant la formule dite proportionnelle et si celui-ci remplit les conditions réglementaires en la matière et après dix après dix (10) années de présence effective dans le secteur il bénéficiera dans ce cas d’un rappel avec effet rétroactif de cinq(5) années. ARTICLE 180: Allocation de décès Lorsque le décès d’un travailleur survient au moment où l a relation de travail est établie depuis au moins une (01) année de travail effective dans le secteur il est attribué une allocation de décès à son ayant droit. L’allocation décès est équivalente à quinze mois (15) du meilleur salaire de l’année du décès soumis à cotisation de sécurité sociale. TITRE XIII DISPOSITIONS DISPOSITION S FINALES ARTICLE 182 : Dépôt de la Convention Collective La présente convention établie en un nombre suffisant d’exemplaires pour être remise à chacune des parties contractantes est présenté aux fins d’enregistrement auprès de l’inspection de travail et du greffe du tribunal territorialement compétent conformément aux dispositions légales. ARTICLE 183 : Entrée en Vigueur de la Convention Collective La Présente convention collective entre en vigueur le lendemain de son enregistrement auprès de l’inspection de travail et du greffe du tribunal. Les dispositions règlementaires actuelles restent en vigueur jusqu'à l’application de la présente convention collective.
