Restaurant means any premises in which is carried on the business of the supply of refreshments or meals to the public or a class of the public for consumption on the premises Residential hotel means any premises in which the business of providing dwelling accommodation and supply of meals to any member of the public or a class of the public is carried on.

the registration has been obtained by misinterpretation or fraud, inspector may give an opportunity for employer for ex planation before license revoke or cancellation for the license to the inspector doesn¶t entitle the grant of registration, whereas refund is possible if grant or renew o f certificate has been refused. there is no communication from inspector regarding grant or renewal of registration certificate within 3 months , then it is deemed to have been gra nted or renewed

A ppeal
against an inspector regarding the revoke or cancellation of grant or renewal of license should be made within 30 days in writing to the state government(can be extended to another 30 days d ays if employer has a valid reason for delay in appeal)

Any
changes in the sec. 4 should be communicated to the inspector in the prescribed form within 7 days after the change has taken place and if inspector is satisfied, he will amend the registration certificate or provided a fresh certificate.

an employer closes the catering establishment should notify to the inspector within 10days and if inspector is satisfied, will remove the name of catering establishment from register. If a worker is terminated by the employer, discharged or dismissed, quits his employment or is superannuated or dies while in service, he or his heir or nominee shall be entitled to wages in lieu of the quantum of leave to which he was entitled immediately before his discharge, dismissal, quitting of employment, superannuation or death calculated at the rates specified even if he had not worked for the entire period specified him eligible to avail of such leave, and such payment shall be made:Worker

The unavailed leave of a worker shall not be taken into consideration in computing the period of any notice not ice required to be given before discharge or dismissal. dismissal. WAGES DUR ING LEAVE PER IOD : -A worker shall be entitled to wages at a rate equal to the daily average of his total full time earnings for the days on which he actually worked during the month immediately preceding his leave (Basic pay + Dearness allowance), exclusive of any overtime.

employee who has been granted leave for a period exceeding 4 days shall, before his leave begins be paid the wages due for the period of the leave allowed.

Notice of discharge or dismissal ± no employer shall dispense with the services of an employee employed for a period of not less than 120 days/6months except for a reasonable cost & without giving a notice at least for 1 month.(not applicable for misconduct of employee). Every
employer shall, on demand, produce for inspection of an inspector, all registers, records and notices required to be kept under and for fo r the purposes of this act.
