Stat. § 117.105 False or fraudulent acknowledgments; penalty.— A notary public who falsely or fraudulently takes an acknowledgment of an instrument as a notary public or who falsely or fraudulently makes a certificate as a notary n otary public or who falsely takes or receives an acknowledgment of the signature on a written instrument is guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
Both false affidavits were filed in the lawsuit by attorney Kevin Stone, Stone & Gerken, P.A. and involve either the attorney(s) misusing notaries public seals, and forging signatures of notaries public; or attorney(s) knowingly putting wrong dates on affidavits calculated to obstruct justice, by compelling two notaries public to falsify two affidavits by attesting attesting to wrong dates. Complaint #1 against notary EDITH GRANT concerns a notary act “Sworn To and Subscribed” April 15, 2015 by affiant Dawn Young, but that date is not correct. The AFFIDAVIT OF DAWN YOUNG is attached, and an d shows a lawsuit heading for a case not filed until April 15, 2016, one year after the purported notary act April 15, 2015 by Edith Grant. This is one of two such affidavits filed in the same lawsuit, each with different notaries public, and each with different affiants, and each showing the same wrong date: April 15, 2015. Each Affidavit purports to be notarized on April 15, 2015, a date which is one year prior to the events that each affiant allegedly appeared before the officer duly authorized to administer oaths and take acknowledgments and deposed upon oath about things that had not yet occurred. Complaint #2 against notary MEAGAN THURSTON concerns a notary act “Sworn To and Subscribed” April 15, 2015 by affiant Steve Balius, but that date is not correct. The AFFIDAVIT OF STEVE BALIUS is attached, and shows a lawsuit heading for a case not filed until April 15, 2016, one year after the purported notary act April 15, 2015 by Meagan Thurston.
