CONTRACT
KNOW ALL MEN BY THESE CONTRACT:
This Contract made and entered into by and between:
AJK CONSTRUCTION, CONSTRUCTION , a sole proprietor duly organized and existing under and by the virtue of the laws of the Republic of the Philippines, with office address at Block 2 Lot 25 Greenside Homes Subdivision, Malagasang 2D, Imus, Cavite presented in this act by its President ENGR. JAY ROBIN B. BORRE, BORRE, hereinafter referred to as the CONTRACTOR; -AndMRS. LINDA LIM, LIM , of legal age and residing at A. Bonifacio Ave, Caloocan City , hereinafter referred to as the SUBCONTRACTOR.
WITNESSETH WHEREAS, WHEREAS, the PROJECT PROJECT is an existing 2-Storey Residential Building, known as MODINA’S RESIDENCES, which has to be demolished, is located at 941 – C Dolores Street, Malate, City of Manila. WHEREAS, WHEREAS , the PROJECT, known PROJECT, known as MODINA’S RESIDENCES, located at 941 – C Dolores Street, Malate, City of Manila, represented by MRS. ZENAIDA C. MODINA , referred to as the OWNER WHEREAS, WHEREAS , the SUBCONTRACTOR is SUBCONTRACTOR is willing and able to undertake the demolition works on the said project in accordance with the previous meeting, site inspection and agreement with the CONTRACTOR; WHEREAS, the WHEREAS, the CONTRACTOR is CONTRACTOR is willing to secure the services of the SUBCONTRACTOR under SUBCONTRACTOR under the said arrangements; NOW, THEREFORE, THEREFORE , for and in consideration of the foregoing premises and the mutual covenants hereunder set forth, the parties hereunto agreed as follows:
ARTICLE I – SCOPE OF WORK: The SUBCONTRACTOR shall SUBCONTRACTOR shall furnish all the manpower, tools, equipment and supervision to perform all the works in accordance with the following: 1. 2.
Securing all necessary permits and licenses. Demolition of the existing Two (2) Storey Residential Building which includes the r oofing sheets, roof framings, reinforced concrete columns, beams and girders and slabs, masonry walls and drywalls, floor finishes, doors and windows including grills, of the aforementioned existing structure excluding the party wall in between the existing house and the adjacent unit. 3. Knocking down and crushing of debris from reinforced concrete members such as columns, beams, girders and slabs, masonry walls, as small as a concrete hollow block, in accordance with previous discussion and agreement. 4. Hauling and disposal of the all the materials, whether usable or not, except for the concrete debris which will be left at site.

ARTICLE II – CONTRACT SUM & PAYMENTS: The SUBCONTRACTOR shall pay the CONTRACTOR the amount of TEN THOUSAND PESOS ONLY ( Php 10,000.00 ) based on agreement during the previous meetings and site inspection, Philippine Currency for the completion of the work. Payments shall made by the SUBCONTRACTOR to CONTRACTOR prior to start of the demolition work.
ARTICLE III – PROJECT COMPLETION TIME Time is of the essence in this contract and upon the failure of the SUBCONTRACTOR to complete the work stipulated with the period provided, excepting those caused by force majeure, the SUBCONTRACTOR shall finish the demolition work at the SUBCONTRACTOR’S expense. Project duration will be SEVEN (7) CALENDAR DAYS.
ARTICLE IV – MISCELLANEOUS ITEMS: (1)
The SUBCONTRACTOR shall pay the necessary fees needed for the Permits and Licenses needed for the commencement of the demolition work including the construction bonds and other dues imposed by the subdivision.
(2)
The SUBCONTRACTOR shall erect and maintain all necessary barricades and scaffolding, temporary or permanent shoring, bracing, supports and anchoring in order to perform the work properly and safely in accordance with all applicable laws.
(3)
The SUBCONTRACTOR shall maintain and observe the highest practice of construction safety at all times. It is required by the CONTRACTOR and the law that the SUBCONTRACTOR shall provide all his site personnel the required and necessary Personal Protective Equipment (PPE) during the entire course of the demolition works.
(4)
Upkeep and cleanliness in the project and its vicinity shall be maintained at all times during the duration of the construction project. The CONTRACTOR is responsible in the cleanliness and upkeep of its materials and facilities.
(5)
Because of the limited time to finish the project, the SUBCONTRACTOR, upon its discretion, could be required to schedule two (2) shifts of work or overtime work depending on the recommendation of the CONTRACTOR.
(6)
Electrical and Water utilities needed for the completion of the PROJECT will be shouldered by the OWNER.
