In course of such endeavors, we have observed that strong advocacy skills, ability to think logically and rationally, combined with acumen for drafting, are some key characteristics that are very necessary for a lawyer in the present scenario. Moot Courts are an essential part of Legal Curriculum, giving budding lawyers the opportunity to take part in simulated court proceedings involving drafting of memorials and presenting oral argument. MOOT PROBLEM: In the case of STATE OF MANDEVILLE V. STATE OF KARAK before THE SUPREME COURT OF KANO 1.
Union of Kano is a democratic republic with 29 States. It has significant presence th
in global arena arena and is noted as fast fastest est developing developing economy economy in the 21 Century and has become a prime spot for investors from all over the world, mainly in the field of technology, development of national railways and offset Government Projects. 2.
Union of Kano, Kano, due to to its geogr geographic aphic locat location, ion, is is rich rich in vari various ous natura naturall nonrenewable resources such as coal and other minerals and being a tropical country,, has abundant renewable resources as Solar Energy country E nergy,, Hydel Energy Ene rgy and Wind Energy. Union of Kano has always been promoting the use of renewable energy.. Union of Kano, now headed by NudiAdami energy N udiAdami Party (NAP) has always been promoting the use of renewable energy and the same has been made as national policy. In addition, Union of Kano has signed a pact with 22 countries, which includes 3 of United Nation permanent members for generation of Solar and Hydel Energy Ene rgy..

Union of Kano, for the sake sake of administration and identification identification is divided into 4 zones namely north, west, east and south. The East Zone has been blessed with flow of various water bodies coupled with favourable soil and climatic conditions, making East Zone an ideal place to for agricultural activities in Union of Kano.

State of Karak Karak and Mandeville Mandeville are are two two neighbouring States in East East Zone in Union of Kano. They were reorganised based on language, which is Kilili and Mandine respectively. Both States have made progress in industry, commerce and also succeeded to make tourism as major source of income. The State of Mandeville is excessively dependent on tourism and nature, because of the wildlife sanctuary located on a vast area and which is i s the home of various exquisite birds, animals and with varieties of flora and fauna alongside the border with the State of Karak. 6

Since reorganisation reorganisation of the States, the two two States States have had stressed stressed relation mainly pertaining to distribution of water from the historical inter-state river Aishani which takes birth in Jaguar Village, State of Karak and travels 800 km to the Great Kano Sea and it's river basin covers 34,273 Sq.km in the State of Karak and 43,856 Sq.km in State of Mandeville.

Though there were series of tensions tensions,, between between the two stat states es in respec respectt of the distribution of water since the two States were re-organised, all the tensions were kept under control by virtue of the State Governments remaining noncommital as the two States were ruled by b y the Kano Adami Party (KAP). Also, the two State Governments were able to enter into water sharing agreement which proposed the construction of a dam named AISHANI JAL across the border region for the purpose of providing water to the drought prone areas in the State of Karak in the year 1970.

The politica politicall scenario scenario in Union Union of Kano was rapi rapidly dly changin changing g and partic particularly ularly in State of Mandeville, a new regional political party by name MandiAdami Party (MAP) mainly based on native Mandine, displaced KAP and formed the Government in State of Mandeville in the year 1985 and even contested in the State of Karak. Karak. Due to ideological ideolo gical differences between the two parties, the JAL project was completely stalled. Around the same time western part of the State of Karak was hit by severe drought claiming about 189 lives. The farmers started protest against Government of Karak, for delaying the execution of AishaniJal project and this turned violent leading to loss of life and property in the State. The said day was observed as Martyrs Day. Day. This lead to change of Government in in the State of Karak and NudiAdami Party came to power in the State of Karak.

The two two States States resumed resumed talk talkss to settle settle the issue. issue. The Stat State e of Karak Karak propos proposed ed that there is need of 7.5 TMC of o f water to solve the issues in western Karak, Karak, which was not agreed to on environmental grounds by the State of Mandeville. State of Mandeville, approached the Union of Kano for referring the matter to the Water Tribunal consisting of both environmental and legal experts. Union of Kano accordingly set up a Water Tribunal Tribunal to resolve the issue.

Meanwhile Meanwh ile,, the Govern Governmen mentt of Karak, Karak, appro approach ached ed the Union Union Governm Government ent,, seeking clearance from the Government for AishaniJal project as the western part of Karak Karak was hit by a severe drought which led to to agitation and bundh and a complete halt of the economy, affecting the State's revenue. The Union 7
Government through the Ministry of Water Resources gave in principle clearance to AishaniJal project and the National Environment Engineering Institute also cleared the same. 10. Having Having learnt of the above above developments, developments, the State State of Mandeville Mandeville approached approached the Water Tribunal seeking for a stay on the clearance given and sought an injunction against the State of Karak to stop the construction of the Jal Project immediately as the same wasaffecting the flora and fauna of the Wild Life Sanctuary. The tribunal was not convinced with this line of argument and thus did not entertain the application and rejected the same. 11. Aggrieved Aggrieved by this, the State State of Mandeville Mandeville has approach approached ed the Supreme Supreme Court of Kano for seeking relief on the following grounds; a. The construction and proceeding with AishaniJal project, has vast and immense adverse ecological effects, effects, hence it should not no t be implemented. b. The requirement of 7.5 TMC water water is excessive excessive and only 3.5 TMC water would suffice the needs of western Karak. c. Since the dispute dispute was raised, there there has been excessive excessive sand mining across the Aishani River in the State of Karak and this has led to changes in the river course as a new development. 12. The State of Karak Karak has denied any ecological adverse impact and highlighted the plight of the people of western Karak and its effect on life for nonimplementation of the agreement entered into in the year 1970. The matter is before the Supreme Court of Kano for final hearing.

The participants are at liberty to consider and propose various water sharing principles that have been applied with regard to sharing of international rivers running through different countries.

Dress Code: The official Dress Code for the Competition is as follows: Ladies: Black trousers, White shirt, Black blazer and Black formal shoes. Men: Black trousers, White shirt, Black tie with Black blazer and formal Black shoes.
III. Language: The entire proceedings in the competition, written as well as oral, shall be in English.
IV. Eligibility: The competition is open for law students currently pursuing their Bachelor's Degree in Law i.e. 3 Year LL.B. or 5 Year LL.B. Programme.
V.
Team Composition Compositi on : Each team shall consist of 3 members. This number cannot be modified under any circumstances. Each team shall include two orators orators,, who will be 9
accompanied by one researcher, all of whom shall have to be accordingly designated during the registra registration tion process. Each team will be allotted a team code. The team code shall be sent to the teams through mail after the registration is complete. Teams shall not disclose their identity or of their institution or city during any time of the competition; such disclosure shall invite penalties including disqualification. The decision for the same shall be at the discretion of the organizers. The entries are restricted to 24 (Twenty Four) teams on first registration basis.
VI. Registration: 1. The registration fee for the national moot court competition is Rs. 2500/- (Two Thousand five hundred only). All the teams are required to make the payment in the form of a bank draft drawn in the name of PRINCIPAL, BMS COLLEGE OF LAW, BENGALURU. Evaluation of Written Submission Submissions: s: The Memorials submitted by the teams will be evaluated by a team of experts and marks will be notified before the commencement of the competition and memorial marks will be carried forward in each round of the competition. (I.e. from Preliminary round to Final round of the Competition). Since the arguments put forth by the competitors are based on memorials submitted, the memorial marks become an essential element in every round of the competition. A total of 100 Marks will be awarded for each side of the Memorandum of Written Submissions. Parameters for Marking Memorandum of Written Submissions shall shal l be: a) Logical progression of ideas. b) Originality in analysis and arguments. c) Understanding essential legal issues presented. d) Clear Clear,, concise and unambiguous writing style. e) Forceful and persuasive presentation. f) Integra Integration tion of facts into legal arguments. g) Understanding and analysis of authority authority.. h) Proper use of citations and citation form. I) Eff Effective ective use of authority to support arguments. j) Neatness, legibility legibility,, no typos or format errors. VIII. Structure of Oral Rounds. The oral round shall comprise of two Preliminary Rounds, quarter- finals, semi finals and a final round. 1. Preliminary Rounds: a. 1. There shall be two preliminary rounds. Every team shall be given the opportunity to argue each side in the preliminary prelimin ary Rounds which shall be determined by way of draw of lots. 2. There shall be two preliminary rounds for 60 minutes each. Every team will get a total of 30 minutes to present their case. The time includes rebuttal and sur-rebuttal.The sur-rebuttal.The division of time between be tween the speakers is at the discretion of the team members subject to the maximum of fifteen minutes for any one speaker and allocation of time must be communicated to the Court-clerk. Any extension of time beyond this specified period is subject to the discretion of the Panel. b. No Orator of a Team shall speak for more than 15 minutes, including the time reserved for rebuttals. c. No team shall reserve more than 5 minutes for Rebuttals. 12

Top four teams of the Quarter-final round shall advance to the semi-finals. 3. Semi Final Rounds: Qualifying teams shall argue only on one side in the Semi- Finals and the side to be represented by the team shall be determined by way of draw of lots. Each qualifying team shall communicate to the court-clerk about their allocation of 45 minutes. 13

Scouting by any of the team members will result in immediate disqualification. The organizers' decision will be final in this regard. 2. The researchers shall sit with the orators at the time of the orals and shall not attend the court sessions of any other team participating in the competition. XI. Accommodation, Accommodat ion, Food and Tr Transport: ansport: 1. Accommodation - Accommodation shall be provided only to the outstation teams on the days of the competition only i.e. from10-12March 2016. It shall be extended to the members of the team (maximum three) only. Team/s shall be responsible for any/all damages caused by them during their stay. 2. Food- Food shall be provided to all the teams on days of the competition. 3. Transport- Transportation Transportation between the accommodation and the college colle ge for the participating teams shall be provided. All teams shall send their travel plan at least 2 weeks prior to their arrival. XII. Code of Conduct: All the participants must behave in a dignified manner and not cause any inconvenience to to the organizer organizers. s. Any participant found found misbehaving with other participants or volunteers will be disqualified immediately immedi ately.. Deference to the Judges of the moot court competition must be maintained inside and outside the Court Hall. Participants will be entirely disqualified from the competition on the following Grounds: 15
a. If found smoking or consuming/ consuming / carrying drugs or alcohol in the campus or place of accommodation. b. If found misbehaving, or causing nuisance, or making abusive statements, showing disrespect towards judges, co-participants or members of the host institution.
