Respondent X------------------------------------------------------------------------------------------------X AFFIDAVIT OF ARRESTING OFFICER I, PO1 Mark Gammad, of legal age, single, regular member of the Philippine National Police based at Nagulian Police Station Naguilian ,Isabela after having been sworn to in accordance with the law do hereby depose and say to wit; 1. On or about 1:00 o’clock in the afternoon of September 4, 2014, a Confidential Informant (CI) who was tasked to monitor the illegal drug activities of @ “JOE”, arrived at our office and informed SPO4 Romeo Montes that he was able to set a drug deal with @ “JOE”. That the CI further informed that @ “JOE” transacts to buyers of shabu with a minimum order of worth One Thousand Pesos. 2. Upon receiving said information, SPO4 Romeo Montes immediately informed our Chief of Police PSI PEDRO DELA CRUZ who then instructed SPO4 Romeo Montes to form a team and plan for the conduct of possible buy bust operation against @ “JOE” based on the information received from our CI; 3. On or about 3:00 o’clock in the afternoon of the same date, SPO4 Romeo Montes formed the team and conduct initial briefing based on the detailed information given by the CI; 4. During the initial briefing, I (PO1 Mark Gammad) was designated as arresting officer while PO1 Norman Pagalilauan will act as poseur buyer. After which our team leader handed to PO1 Norman Pagalialauan one (1) piece genuine one thousand peso marked bill
with serial no. CG121147 which was previously put into record by the duty officer in our PNP blotter. It was also agreed that the prearrange signal to be used once the transaction consummated is that PO1 Norman Pagalilauan will remove his cap and I,(PO1 Mark Gammad), including the rest of the team shall rush up to the place of transaction. 5. On or about 4:30 in the afternoon of the same date, the team proceeded to Hilltop Naguilian , Isabela waiting shed beside Naguilian National High School for the conduct of possible anti- illegal drug buy bust operation; 6. SPO4 Romeo Montes instructed us (PO1 Mark Gammad , PO1 Norman Pagalilauan & CI) to proceed to the designated area of transaction which is in Hilltop Naguilian, Isabela and we positioned ourselves strategically within the area of transaction. After minutes of waiting, PO1 Norman Pagalilauan noticed that several motorcycle passing along the Highway and suddenly a motorcycle stopped where PO1 Norman Pagalilauan standing .A male person approached him (PO1 Norman Pagalialauan) and the CI immediately introduced him(PO1 Norman Pagalilauan) as his friend who will buy shabu. A conversation ensued between them (PO1 Norman Pagalilauan, CI and @ “JOE”) after which,@ “JOE”immediately asked for the payment as he (@ “JOE”) brought out his wallet and handed to PO1 Norman Pagalilauan two (2) pieces heat sealed transparent plastic sachet containing white crystalline substance suspected to be Methamphetamine Hydrochloride known as “shabu” and in return he (PO1 Norman Pagalilauan) gave the one (1)thousand pesos as the buy bust money consisting one (1) piece genuine one thousand peso marked bill. Upon confirming that the content of the plastic sachet is indeed shabu, immediately he (PO1 Norman Pagalilauan) gave the prearrange signal which is removing his cap .I,( PO1 Mark Gammad) and the rest of the team immediately alighted from our motorcycle service and identified ourselves as Police. I,(PO1 Mark Gammad) immediately held and frisked @ “JOE” and conducted body search, recovered from his direct control and possession the one (1) thousand buy bust marked money, one (1) unit of nokia ASHA 303 cellular phone and the confiscation of a black wallet recovered containing three (3) pieces heat sealed transparent plastic sachet containing white crystalline substance and money in different denominations amounts to Five (5) Hundred Pesos (Php.500.00). 7. @ “JOE” was inform of his violation in selling and possessing of dangerous drugs and thereafter I,(PO1 Mark Gammad) appraised him of his constitutional rights but he opted to remain silent. The team together with the arrested suspect immediately proceeds to Naguilian Police Station for the conduct of marking, inventory and documentation of confiscated pieces of evidence. The arrested person
was later identified as EDRIC JOE OLANGCO, 19 years old, single, jobless and a resident of Barangay Roxas Naguilian, Isabela The inventory of the pieces of evidence were done in the presence of the arrested person (EDRIC JOE OLANGCO) as witnessed by Hon.Alex Bartolome,Chairman of Brgy.Magsaysay Naguilian, Isabela and Atty. Efren Garcia a Representative from the Department of Justice (DOJ). No representative from the media witnessed the inventory despite earnest efforts made in requesting their presence. 8. The confiscated suspected shabu were immediately forwarded to Provincial Crime Laboratory Office based at Police Provincial Office Ilagan City, Isabela 9. I am executing this affidavit freely and voluntarily as I attest to the truthfulness and veracity of the above mentioned facts.
