Summary of Occupational Safety & Health (Notification of Accident, Dangerous Occurrence, Occupational Poisoning and Occu pational Disease) Regulations 2004 1. Compliance with these regulations shall be deem to have complied with the pro visions of: bullet sections 31 and 32 of the Factories and Machinery Act 1967 bullet bullet regulation regulation 13 of the Petroleum Petroleum (Safety (Safety Measures) Measures) (Transport (Transportation ation of Pet roleum by Pipelines) Regulations 1985; and bullet bullet regulation regulation 23 of the the Occupati Occupational onal Safety Safety and Health Health (Control (Control of Industri Industri al Major Accident Hazards) Regulations 1996
2. The employer must notify the nearest DOSH office immediately, and send a repo rt on the approved form within seven days whenever any accident arising in conne ction with work that caused: bullet death to any person; or bullet bullet serious serious bodily bodily injury injury as specifie specified d in the the First First Schedul Schedule, e, which which prevents prevents the person from performing his normal work for more than four calendar days; or bullet bullet where a dangerous dangerous occurrence occurrence as specifi specified ed in the the Second Second Schedul Schedule e has tak tak en placed 3. The employer must notify the nearest DOSH office on the approved form within seven days, whenever any work accidents has caused bodily injury which prevents the person from performing his normal work for more than four calendar days 4. The employer must inform the Director General of DOSH in writing should an em ployee who has been involved in an accident described in (2) above, dies within one year of the date of the accident 5. Where a person suffers from or likely suffer from occupational poisonings poisonings or occupational diseases specified in column 1 of the Third Schedule and the work as specified, the employer shall send a report to the nearest DOSH office on the approved form within seven days 6. A registered medical practitioner or medical officer attending to the patient who he believes is suffering from occupational poisonings or occupational disea ses specified in column 1 of the Third Schedule shall report the matter to the n earest DOSH office on the approved form within seven days, and notify the employ er 7. Where an accident or dangerous occurrence causing death, serious bodily injur y or serious damage to property, no person unless authorized by DOSH shall remov e, interfere or disturb the scene of the incident, except to the extent of savin g lives, prevent further injury, maintain access to the site or prevent further damage or serious loss of property or environment 8. All employers shall record and maintain a register, in an approved form, all accidents and dangerous occurrence which have occurred, and all occupational poi soning and occupational disease which have or or are likely to occur 9. Every entry in the records shall be kept for at least 5 years
10. The employer shall send an extract for for the last 12 months from the reco rds every year to the DG before 31st January of the following year 11. The DG may served notice for further information after the initial notificat ion made by the employer 12. Maximum Penalty for non compliance is RM10,000 or 12 months imprisonment or both
