Resolution No. 28 S. 2013 A RESOLUTION DEFINING AND IMPLEMENTING THE INTERNAL RULES OF PROCEDURE OF THE SANGGUNIANG BARANGAY OF CRUZ FOR THE YEAR 2013-2016. WHEREAS, the Sangguniang Barangay of Cruz is a legislative body duly organized pursuant to law for the enactment of ordinance and the adoption of resolution for the governance of Barangay Cruz; WHEREAS, pursuant to the provision of Republic Act 7160, otherwise known as the local Government Code of 1991, and Book 1, chapter 3, section 50 provides that the local Sangguniang bodies have the inherent right and obligations of adopting its own rules of procedure for the proper discharge of legislative functions; WHEREAS, Section 50 of the same Code, likewise, provides that the Sanggunian, within ninety (90) days following the election of its members, shall adopt its Internal Rules of Procedure in order to achieve a maximum degree of efficiency in the deliberation of issues during their sessions; WHEREAS, in the maintenance of good order in the Sangguniang deliberation, it is necessary for the specific rules be adopted and enforced in the interest of effective legislation; NOW THEREFORE, be it resolved, that the following Internal Rules of Procedures as mandated in Section 50 of the Local Government code of 1991, are hereby adopted;

RULE I. ORGANIZATION OF THE SANGGUNIANG BARANGAY SECTION 1. COMPOSITION -The Sangguniang Barangay of Cruz shall be composed of the Punong Barangay as Presiding Officer and seven (7) members elected at large. Punong Barangay Kagawads

SECTION 2. TERM OF OFFICE -the term of office of the members of the Sangguniang Barangay of Cruz shall be three (3) years or if sooner or later amended, which shall commence on such date as may be provided by law.

SECTION 3. OATH OF AFFIRMATION -All members of the Sangguniang Barangay of Cruz, shall upon assumption to office, take an oath or affirmation in the prescribed form, duly subscribed before a person authorized to administer oaths.

Copies of Oath or Affirmation of office shall be filed and preserved in the office of the Municipal Local Government Operation’s (MLGOO) of La Trinidad, Benguet.

SECTION 4. STANDING COMMITTEES

i.

The Sangguniang Barangay shall elect the chairman and members of the following standing committees headed by the Punong Barangay, but with a chairman to primarily oversee the committee, aside from those mentioned in section 50, of the Local Government Code of 1991, the general jurisdiction of which shall be as hereunder provided.

a) COMMITTEE ON FINANCE AND APPROPRIATIONS -all matter relating to the approval of the budget; the appropriation of funds for the payment of obligations; the determination of compensation of personnel; the re-organization of local offices; taxation ordinances and mone tary and fiscal matters.

b) COMMITTEE ENVIRONMENTAL PROTECTION -all matters relating to the protection of communal forest, water sheds, exploration development, utilization and conversation of natural resources and other related to environmental protection. - All matters relating to the implementing local ordinances regarding Solid Waste Management as provided in R.A 9003. - All matters relating to the strengthening and development of family life; public health and hygiene; medical hospital and guarantee services; human


Page 3 of 18 18 ecology and settlement; social service and ameliorative services; housing and resettlement. c) COMMITTEE ON EDUCATION AND CULTURE-all matters relating to Education and Culture local school, colleges and Universities, libraries and museums; non-formal and community-adult education; Scientific and Technological Research; Development and Advancement; and moral and religious formation of the community. d) COMMITTEE ON PUBLIC RELATIONS AND TOURISM -all matters relating recreation; promoting and developing of all identified tourist spot of the locality. - all matters relating to Organization and supervision of local cooperative and review of all constitution and bylaws pass by the different Organization for approval and for accreditation of the Barangay. - All matters related to Public Utilities and Communication-all matters relating to the practice of good practice of all utilities such as PUJ, Taxi plying the vicinity of the Barangay and Telecommunication services e) COMMITTEE ON HUMAN RIGHTS -all matters relating to the maintenance of public order and security; civil defense; liaison with the Philippine National Police; organization organization and maintenance of “Tanods”; implementation of local ordinances; revision and/or enforcement of the Sangguniang rules and procedures; codification of ordinances; human right; legal aid; audit probation; maintenance of punitive or corrective institutions; fire; accident and crime prevention; investigation of charges of misfeasance, malfeasance against local officials and employees; and the conduct; rights; privileges; safety, dignity, integrity and reputation of the sangguniang in its members. Information Education Campaign regarding values of good citizen or Good Manners and Right Conduct (GMRC) to all residents. f) COMMITTEE ON PUBLIC WORKS AND INFRASTRUCTURE -all matters relating to planning, construction, maintenance, improvement and repair of public buildings, highway, bridges, roads, parks, shrines, monument and other public edifices, drainage, sewerage and flood control and protection; irrigation and water utilities; tourism; lands, sea and transportation. g) COMMITTEE ON TRADE AND INDUSTRY -all matters relating to trade and industries. h)

COMMITTEE ON AGRICULTURE, LAND AFFAIR AND ZONING - all matters relating to soil survey and conservation - All matters relating Agriculture; food production and Agri-business; economic and research; agricultural education and extension services.

i)

COMMITTEE ON WOMEN AND FAMILY -all matters relating to the implementation of all local laws for the protection of child, women, family and senior citizens.

j)

COMMITTEE ON YOUTH, SPORTS AND PHYSICAL DEVELOPMENT -all matters relating to the youth; the promotion of the youth’s spiritual, moral, physical, intellectual and social well being; Barangay Youth Council; and the development of sports and sportsmanship of the community.

ii.

Whenever a measure covers subject matters falling within the jurisdiction of more than one Committee, said measure should be referred jointly to the committee concerned.

iii.

Officers, Election-each standing committee shall have a chairman, Vice-Chairman and members, who shall be elected by the majority vote of the Sangguniang from among its members.

iv.

Limitations- No Sanggunian Member shall have a chairman of more tham two standing committee.

v.

The Punong Barangay shall have a voice and vote in all committee. No member of a committee shall act upon or participate in any matter in which he has a special, direct and substantial interest.

vi.

Special Committees – The The Sangguniang may organize special committees, as it may deem necessary. The officers and members of special committees shall likewise be elected by the majority vote of all the Sangguniang members. (i.e. Creation of Screening Committees for special affairs or events)

vii.

Vacancy- Whenever a vacancy occurs or is declared to exist in any of the committees, the same shall be filled by election of the Sanggunian.

viii. The committees shall determine the frequency of their meetings or hearings, provided they meet at least once a month. A majority of all the members of the committees shall constitute a quorum. Committee meetings or hearings shall be held within or outside the Barangay.

ix.

Committee Report/s and/or Orders on any ordinance or resolution shall be considered in formal meetings and shall not be submitted to the Sanggunian unless accompanied by the Minutes of the Meeting or hearing of the committee, adopting them.

x.

When a committee submits a report, the member thereof shall be presumed to have concurred in the report and shall be precluded from opposing the same, unless they have entered their objection thereto during the committee meeting.

RULE II. POWERS, DUTIES AND FUNCTIONS OF THE SANGGUNIAN SECTION 1. Every member of this sanggunian shall make a full disclosure of his financial and business interests as required of him under art 104, Rule XVII of the Rules and Regulations implementing the Local Government Code of 1991. SECTION 2. Every member shall attend all the sessions of the sanggunian unless he is prevented from doing so by reason of sickness and other unavoidable circumstances provided that, as a general rule, previous notice thereto shall be sent to the Sanggunian thru the Presiding Officer or the secretary.

SECTION 4. Every member shall observe proper deportment and decorum during sessions. SECTION 5. THE PUNONG BARANGAY is the presiding officer of the Sangguniang Barangay who shall perform the following duties: A. Exercise such powers and perform such duties and functions, as provided by R.A 7160 (LG Code) and other laws. B. For efficient, effective and economical governance, the purpose of which is the general welfare of the Barangay and its inhabitants pursuant to section 16 of this code, the Punong Barangay shall:

1. Enforce all laws and ordinances which are applicable within the barangay; 2. Negotiate, enter into, sign contracts and in behalf of the barangay, upon authorization of the Sangguniang barangay; 3. Maintain public order in the barangay and, in pursuance thereof assist the Municipal mayor and the Sangguniang Bayan members in the performance of their duties and function; 4. Call preside over the session of the Sangguniang Barangay and the Barangay assembly, and vote only to break the tie; 5. Upon approval by a majority of members of the Sangguniang barangay , appoint or replace the barangay treasurer, the barangay secretary, and other appointive barangay officials; 6. Organize and lead an emergency whenever the same may be necessary for the maintenance of peace and order or on occasion of emergency or calamity in the barangay; 7. In coordination with the development council, prepare the annual executive and supplemental budget of the barangay; 8. Approve Vouchers relating to the disbursement of barangay funds; 9. Enforce laws and regulations relating to pollution control and protection of the environment; 10. Administer the operation of the Katarungan Pambarangay in accordance with the provisions of law; 11. Exercise general supervisions over the activities of the Sangguniang Kabataan;


Page 7 of 18 18 12. Ensure the delivery of basic services as mandated under Section 17 of the Local Government Code of 1991 13. Conduct an annual Paralong Pambarangay which shall feature traditional sports and discipline included in national and international games, in coordination of the Department of Education; 14. Promote the general welfare of the Barangay; and 15. Exercise such other powers and perform such other duties and functions as may be prescribed by law or ordinance. C. In the performance of his peace & order function, the Punong Barangay shall be entitled to possess and carry the necessary firearm within his/her territorial jurisdiction, subject to appropriate rules & regulations. regulations.

SECTION 6. ABSENCE OF THE PUNONG BARANGAY - In the absence of the Punong Barangy the Barangay Secretary and Officer of the Day are duly authorized to sign barangay Clearances, Business Permits, Memorandum of Agreements and o ther pertinent documents on behalf of the Punong Barangay, provided they are amenable with the law. SECTION 7. REPORTING OF ANY UNTOWARD INCIDENCE- Barangay Officials on Duty are mandatorily required to put on record any untoward incidents reported to them, they are also mandated to indicate the actions taken and or works done relating to the incident SECTION 8.REPORTING OF COMMUNICATIONS FROM GOVERNMENT OFFICES AND LINE AGENCIES- Barangay Officials are required to take note or receive communications/ instruction/ letters coming from the National Government, Local Government and other line agencies. The y are also required to report this directly to the Punong Barangay or Barangay Secretary for record keeping and Information dissemination purposes. SECTION 9. APPOINTIVE BARANGAY OFFICIALS- Appointments are made by the Punong Barangay with the concurrence of majority of the Sanggunian Members. A majority of the Sangguniang Barangay which consists of nine (9) members is five(5). Hence appointments must be concurred by b y at least five(5) members of the Sanggunian - No Person shall be appointed by the Punong Barangay if he/she is a sangguniang Barangay, a government employee, or a relative of the latter within the second civil degree of consanguinity or affinity. - It is required by law that to be qualified for the appointive positions the person must b e of legal age, a qualified voter and an actual resident of the barangay. Thus when a person ceases to beca qualified voter of the barangay, he becomes ineligible to continue holding office, the same is true if transfers residence to a different barangay. A. THE BARANGAY SECRETARY

- shall be appointed by the Punong Barangay with concurrence of the majority of all the Sangguniang Barangay members. m embers. His/her compensation/ allowance and other emolument shall be determined by law or ordinance. - The appointment of the Sangguniang secretary shall be in accordance with civil service, rules and regulations. Page 8 of 18 18 d) Prepare and certify the minutes of the session of the Sangguniang Barangay; e) Read all correspondence and resolutions which are required by the Sanggunian or by the Presiding Officers; f) Forward to the Sangguniang Bayan, a correct copy of each resolution and approved ordinance within ten (10) days after the Sangguniang Barangay; g) Keep custody of all records of the Sangguniang Barangay and the Barangay Assembly meetings; h) Prepare a list of members of the barangay baranga y assembly, and have the same posted in conspicuous places within the barang ay; i) Assist the municipal civil registrar in the registration of births, death, and marriages; j) Keep an updated record of all inhabitants of the barangay containing the following items of information: name, address, place and date of birth, sex, civil status, citizenship, occupation, and such other items of information as may be prescribed by law or ordinance; k) Carry out or enforce orders of the Sangguniang Barangay when such duty devolves upon him; l) Exercise such other powers and perform such other dutie and functions as may be prescribed by law or o r ordinance B. THE BARANGAY TREASURER

The Barangay Treasurer shall be appointed by the Punong Barangay with concurrence of the majority of all the sangguniang Barangay members. His/her compensation/ allowance and other emolument shall be determined by law or ordinance. The Barangay Treasurer shall be bonded in accordance with existing laws in an amount to be determined by the sangguniang Barangay, But not exceeding ten thousand pesos (10,000.00Php), premiums for which shall be defrayed by the Barangay. Powers and duties of the Barangay Secretary shall: a) Keep custody of barangay funds and properties; b) Collect and issue official receipts for taxes, fees, contribution, monies, materials, and all other resources accruing to the barangay treasury and deposit the same account of the barangay as provided under Title Five, Book II of the Local Government Code of 1991; c) Disburse funds in accordance with the financial procedures provided in the Local Government Code of 1991; d) Submit to the Punong Barangay as a statement covering the actual estimates of income and expenditures for the preceding and ensuing calendar years, respectively, subject to the provision of Title Five, Book II of the Local Government Code of 1991; e) Render a written accounting report of all barangay funds and property under her custody at the end of each calendar year, and ensure that such report shall be made available available to the members of the Barangay assembly and other government agencies concerned; f) Certify as to the availability of funds whenever necessary; g) Plan and attend to the rural postal circuit within her jurisdiction; and h) Exercise other powers and perform such other duties and functions as may be prescribed by the law or ordinance.

RULE III. SESSIONS AND QUORUM SECTION 1. SESSIONS- The Barangay shall hold regular sessions twice a month and also such number of special sessions as may be called by the punong Barangay Ba rangay or by majority of the members of the Sangguninag Barangay at any time.

a) The first monthly regular session of his Sanggunian is scheduled every first Sunday and the second monthly monthl y regular session every third Friday of the month b) Regular session shall be held at the Baranga y Hall and shall start at exactly 1 o’clock in the afternoon a fternoon on the first regular session and 5 o’clock in the afternoon for the second regular session. c) Regular sessions of this Sanggunian shall be in public and the presiding offices has the authority to exact from those present present respect and proper deportment. Sessions may only be deemed closed to public in cases of security, decenc y or morality, or for reason affecting the dignity of the Sanggunian or any of its members, or when confidential matters are being considered d) Only the security and such other person are specifically authorized by the Sanggunian shall be admitted to the closed session. They shall preserve secrecy of whatever may be read or said at the session. e) As often as necessary, when public interest so deman d, special sessions may be called by the Punong Barangay or majority of the members of the Sanggunian. No two sessions shall be held in one day. f) Unless otherwise agreed upon by two-thirds (2/3) vote o f the members present, there being a quorum, no other matter may be considered at a special session except those stated on the notice. g) In special Sessions, a written notice or text/call to the Sangguniang Barangay members, two (2) days before the sched uled session stating the date, time and purpose of the session, must be sent by the secretary. Unless otherwise agreed upon by majority of the members present, their being quorum, no other m atter may be considered at a special session except those stated in the notice. SECTION 2. QUORUM- The Majority of the Sangguniang Barangay Members shall constitute a quorum, composed of (1) Presiding Officer and at least (5) Sangguniang Barangay members and in case of the absence of Quorum, the business of the Sanggunian shall not be discussed. a) When the quorum is lacking, a majority of those in actual attendance may adjourn form time to time and may enforce immediate attendance of any member absent b) Should a question of lack of quorum be raised, the presiding officer shall immediately proceed to call the roll of the members and thereafter announce the results c) If there is still no quorum in spite of the above, no other business shall be translated and the presiding officer upon proper motion or on majority of the members present shall declare the meeting adjourned for lack of quorum

SECTION 3. THE PRESIDING OFFICER- The Punong Barangay is the presiding officer of the Sangguniang Barangay who shall perform the following powers and duties: a) Preside over the Sanggunian, the Barangay Assembly and the meetings in the barangay;


Page 10 of 18 18 b) Decide all points of order; c) Preserve order and decorum during the session; d) Announce the business in the order in which it is to be acted upon by the Sanggunian; e) Entertain only one motion at a time and state all motions properly; f) Recognize only one member who is entitled to the floor; g) Call a special meeting session by giving written notice of it to each member of the Sangguninag Barangay; h) Appoint, with the approval of the Sanggunian the Chairman and member of the standing committees SECTION 4. TEMPORARY PRESIDING OFFICER- If the Punong Barangay cannot Preside a regular/Special Session, the Sanggunian Barangay members present and provided they constitute a quorum, shall elect from among themselves a temporary presiding officer unless the Punong Barangay authoarizes someone from the council to preside in his/her behalf. The temporary presiding officer shall not vote even in case of a tie but shall certify within ten(10) days from the passage all ordinances and resolutions enacted or adopted by the Sangguniang Barangay of CRuz

RULE IV. ORDER OF BUSINESS SECTION 1. ORDER OF BUSINESS The order of business of the Sangguniang Barangay shall be as follows:

SECTION 2. AGENDA – Matters that may be taken up in the session shall be limited only to those items listed in the agenda SECTION 3. APPEARANCE BEFORE THE SANGGUNIANG BARANGAY – Only Only persons with prior permission from the Barangay Secretary shall be allowed to speak before the Sanggunian SECTION 4. MATTERS REFERRED TO COMMITTEE – Any Any measure appearing in the agenda to reference for the corresponding committee shall not be subject to debate or discussion, prior to final action SECTION 5. URGENT MATTERS – urgent matters which may be brought to the attention of Sangguniang Barangay, the delay in the consideration of which shall prejudice activities of the government, may be discussed in the session without being listed in the agenda.

Its consideration shall be presumed until such unfinished business is disposed of. Thereafter the presiding officers shall call for the business of the day. b) Business for the day- Proposed ordinances, resolutions and other measure/matters set on the calendar for the consideration on motion of a member with unanimous approval of the Sanggunian Members present at the session, there being a quorum -

The calendar shall be distributed on the day of the session, unless there be no addition to the one previously distributed, in which case a note to this effect on the order of business shall be sufficient.

RULE V. THE LEGISLATIVE PROCESS SECTION 1. RULES IN THE ENHANCEMENT OF ORDINANCE AND ADOPTION OF RESOLUTIONS including other matters requiring legislative actions, the following rules shall be observed.

Legislative actions of a general and permanent character shall b e enacted in the form of ordinances, while those which are of temporary character shall be passed in the form of resolutions. Matters relating to proprietary functions and to private concerns shall also be acted upon by resolutions. Proposed ordinances and resolutions shall be in writing and shall contain an assigned number, a title or caption, an enacting or ordaining clause, and the date of its proposed effectively. In addition, every proposed ordinance shall be accompanied by brief explanatory note containing the justification for its approval. It shall be signed by the author or authors and submitted to the secretary who shall report the same to the Sanggunian at its next session. The Sanggunian member/ Author shall submit all proposed o rdinances and resolutions to the secretary at least three(3) days before regular session and the e secretary to the Sanggunian Sang gunian shall prepare copies of the proposed ordinance or resolutions of the form it was passed on second reading, and shall as distribute to each sanggunian member a copy thereof except that a measure certified by the local chief executive as urgent maybe submitted for the final voting immediately after it has unde rgone the periods of debate and amendment during the second reading. A resolution shall be enacted in the same manner prescribed for an ordinance, except that it need not go through a third residing for its final consideration unless decided otherwise by the majority of the sanggu nian members present. No ordinance or resolution shall be considered on second reading in any regular meeting unless it has been reported out by the proper committee to which it was referred or certified as urgent b y the local chief executive. Any legislative matter duly certified by the local chief executive as urgent whether or not it is included in the calendar of business maybe presented and considered by the body at the same meeting without need of suspending the rules. No ordinance or resolution passed by the Sanggunian in the regular, or special session duly called for the purpose, shall be valid unless approved by a majority of the members present, there being a quorum or has been reported out by the committee to which it was referred to, and certified as urgent by the Punong Barangay.


Page 12 of 18 18 h) The First Reading of a proposed ordinance or resolution shall only be by title and, thereafter, the same shall be referred to the appropriate committee for review before the second reading p ursues. i) An erroneous referral of a proposed ordinance or resolution maybe corrected any day after the approval of the minutes. j) Only the chairman or the vice-chairman of the committee to which a proposed ordinance or resolution was erroneously referred, as well as the chairman or vice-chairman of the committees claiming jurisdiction over the proposed ordinance or resolution, may move that the referral be declared erroneous, and ask for its correction. However, the presiding presiding officer may motu propio rectify an erroneous referral. k) The committee shall submit a report on the proposed ordinance or resolution within Thirty (30) days after it has been referred to it. l) If the committee report on a proposed ordinance or resolution is favorable, it shall be included in the Calendar of Business if it is unfavorable, it shall be laid on the table and, within Ten (10) days, notice of action taken will be furnished to the author or authors concerned stating the reason or reasons for such action. Provided that within Five (5) days after receipt of the notice the Sangguniang may reconsider the committee recommendation. m) Any legislative matter duly certified by the Punong Barangay as urgent, whether or not it is included in the Calendar or Business, may be presented and considered by the Sangguniang in the same session without need of suspending the rules. n) Upon the passage of all ordinances and resolutions directing the payment or money or creating a liability, and at the request of any member, the Sanggunian secretary shall record the ayes and the nays. The Sangguniang, likewise, may, on motion made by the Chairman or vicechairman of the committee concerned, consider a propose ordinance or resolution as urgent and consideration thereof shall be scheduled according to time table. If said motion is approved , the Sangguniang shall forthwith prepare a detailed time table of the dat e on or before which the proposed ordinance or resolution must be reported by the committee concerned, the number of days or hours to be allotted to the consideration of the measure on Second Reading, and the date or hour at which proceedings must be concluded and final vote on said measure taken. o) On the day set for the consideration of a proposed ordinance or resolution for second reading, the same shall be read in full with the amendments proposed by the committee, if any, unless copies thereof have been distributed earlier and such reading is dispensed with. Thereafter, the proposed ordinance or resolution shall be subject to debate and pertinent motions. p) After amendments have been acted upon, the proposed ordinance or resolution shall be voted on Second Reading and shall be included in the calendar for third reading q) No ordinance shall be approved unless it has passed three readings, approved by a majority of the members present, there being quorum, and copies thereof in its final form have been distributed to the member at least three (3) days before its passage, except when the Punong Barangay or the Sangguniang certifies to the necessity of its immediate enactment to meet a public calamity or emergency. Upon the Third Reading of a proposed ordinance or resolution. No amendment thereto shall be allowed, and the vote thereon shall be taken immediately thereafter and the ayes and nays entered in the minutes. r) A resolution shall be enacted in the same manner prescribed for ordinances, except that it need not to go through a separate Third Reading


Page 13 of 18 18 for its final consideration unless decided otherwise by a majority of all the Sangguniang members. s) Each approved ordinance or resolution shall be stamped with the seal of the Sangguninan and recorded in a book kept for the purpose. t) The Sanggunian shall in no case increase the appropriate of any project or program of any office of the Barangay over the amount submitted by the Punong Barangay in his budget proposal. u) After the Punong Barangay shall have submitted the annual general appropriation measure, supplemental appropriation measured shall be considered only if supported by actually available funds as certified by the local treasurer or by funds to be raised by corresponding revenue proposals included therein. SECTION 2. REVIEW OF THE SANGGUNIANG BAYAN - Within Ten (10) days after enactment, the Sangguniang Barangay shall furnish copies of the Barangay ordinance to the Sangguniang Bayan for the review, as to whether the ordinance is consistent with law, and with municipal ordinance.

Failure on the part of the Sangguniang Bayan to take action on Barangay Ordinance within thirty (30) days from receipt thereof, said ordinance shall presumed consistent with law and with municipal ordinances and thereof valid. If within thirty (30) days, the Sangguniang Bayan finds the Barangay ordinance inconsistent with law or with municipal ordinances, the Sangguniang Bayan shall return the ordinance with its comments and recommendations to the Sangguniang Barangay for adjustment, amendment or modification, in which case, the effectively of the ordinances shall be deemed suspended. SECTION 3. ENACTMENT, ENFORCEMENT AND DISAPPROVED MEASURES- Any attempt to enforce, promulgate or execute any ordinance, resolution or executive order after the disapproval thereof shall be sufficient ground for the suspension or dismissal of the officer making such attempt.

Unless otherwise stated in the ordinance or resolution, the same shall take effect after the lapse of ten (10) days from the date a copy thereof is posted in a bulletin board at the entrance of the Barangay Hall, and at least two (2) other conspicuous places, such as the Barangay Hall, Church or chapel. Not later than five (5) days after the passage of the ordinance or resolution, the Sangguniang Secretary shall cause the posting thereof in English together with the copy translated in the dialect used by the majority of the people in the area, and shall record such fact in a book kept the purpose, stating the date of approval and posting thereof.

RULE VI.

THE PARLIAMENTARY PROCESS

SECTION 1. MOTIONS AND THEIR PRECEDENCE a) Privilege and Subsidiary Motions – Motions – When When the questions are under debate, no motion shall be entertained except the following and in the order in which they appear below. 1. Motion to adjourn 2. Motion to declare a recess 3. Motion to postpone temporarily 4. Motion to postpone on a certain day 5. Motion to refer to the corresponding committee co mmittee

Motion to postpone indefinitely the consideration of an y business b) Question of privilege – privilege – Questions Questions relating to the rights and privileges of the Sangguniang Barangay or to any to its members, shall take precedence over all motions except motions relating to adjournment and recess. This may involve the following: 1. Those relating to the organization of the Sangguniang Barangay 2. Those relating to the comfort of the members of the sanggunian, like seating, lighting, ventilation and other inconveniences o f the session hall 3. Those relating to the freedom from noise and conduct of other persons inside the session hall 4. Those relating to the punishment of a member for disorderly conduct or other offense. 5. Those affecting the rights of the Sangunian; its safety, dignity and the integrity of its members 6. Those affecting the rights, reputation and conduct of the members individually, in their capacity as members c)

Incidental motions – motions – The The following motions shall take precedence of any motion, to which they are incidental and must be decided before any other business is taken up. 1. Point of Order – Order – Any Any Sanggunian Barangay member may interrupt a speaker to bring to the attention of the presiding officer any matter involving an error in procedure or violation of the rule. 2. Parliamentary Inquiry – Inquiry – Any Any request for information as in order if they are pertinent to a pending question 3. Withdraw a motion – motion – A A motion by the sponsor requesting of the removal of his main motion from the consideration of the sanggunian shall be in order before its amendment and before the decision is made thereon 4. Suspend the rules – the rules shall be suspended when a motion presented to that effect is approved by two-thirds of the members present. When a motion to suspend the Rules pending, one motion to adjourn may be entertained. If it is lost, no similar motion shall be entertain until the vote is taken on the motion to suspend.

d) Amendments in motions- When a motion or proposition is under consideration, a motion to amend shall be in order. It shall also be in order to offer further amendment by substitution, but shall not b e voted upon until the original motion or proposition is perfected. Any of said amendments maybe withdrawn before a decision is had thereon. - Amendments to the title of a proposed ordinance o rdinance or resolution shall not be in order until after the text thereof has been perfected. Amendments to the title shall be decided without debate - No motion or proposition on a subject different from that under consideration shall be allowed under color of amendment. All foregoing motions are not debatable. SECTION 2. VOTING – no no motion except in the presence of a quorum shall be entertained during the voting. Any member may explain his vote when voting for the debatable motion. When the motion is not debatable, no other remarks will be entertained by the chair when a member cast his vote.

On a vote where affirmative and negative are equal in number, the motion shall be


Page 15 of 18 18 declared lost. If a tie has taken place, the Punong Barangay may, at his discretion, cast the deciding vote. A two-thirds vote is required to pass any of the following motions (a) to limit, extend or close a debate (b) To amend any part of the adopted rules (c) To suspend the rules (d) To suspend or recommend the expulsion of any member for cause. No member could be compelled to vote, he may not sustain. The motion to reconsider can be made only the member who voted on the prevailing side. Any member who abstained from voting shall have no right to ask the reconsideration No member can vote on a question in which he has direct or personal pecuniary interest SECTION 3. DECORUM AND DEBATES

(a) Whenever a member wishes to speak he shall rise and request the presiding officer to allow him to have the floor in which consent shall be necessary before he may proceed. (b) When several members wish to have the floor, the presiding officer shall recognize the one who first made the request (c)No member shall occupy more than fifteen (15) minutes in debate on any question or speak for more than once on any question without leave of the Sanggunian, except herein after provided. The period of interpellation shall not be counted against time of the member speaking (d) No member shall interrupt another without the latter’s, la tter’s, which may not be obtained except through the chair (e) The presiding officer can volunteer information only when necessary. Before participating in the deliberation of any question before the Sanggunian, he should first surrender the chair temporarily to some other member (f) If at any time, the presiding officer states a point of order, or give information otherwise speak, with his privilege, the member speaking must take his seat until the presiding officer has been first heard (g) No member shall walk out or across the session hall while the presiding officer is addressing the Sangguniang Barangay, or while the Sanggunian is engaged in voting. (h) A member who has obtained the floor shall confine himself to the questions before the sanggunian and shall avoid personalities. He shall refrain from uttering words, or performing acts which which are inconsistent with decorum (i) No member shall claim the floor the second time if there are others who wish to speak for the first time (j) If it is requested that a member be called to order for words spoken in debate, the member making such request shall indicate the words accepted to and they shall be taken down in writing by the secretary and read aloud. The


Page 16 of 18 18 member who uttered such words shall not be held to answer, nor be subjected to censure by the Sanggunian if further debate or other business has intervened. (k) All Sangguniang Barangay members, including the Barangay Secretary and Barangay treasurer, when attending the session, shall be in semi-formal attire. (l) Sangguniang Barangay members shall avoid drinking liquor and other intoxicating substances before attending and during session or during recess of session

RULE VII. DISCIPLINE OF MEMBERS SECTION 1. ABSENCES AND TARDINESS DURING REGULAR SESSIONS

a. A Sangguniang Barangay member intending to be absent must provide a letter of intent to be absent at least three (3) days before the Regular meeting addressed to and for approval of the Punong Barangay. b. In case the above has not been provided, absent members shall explain the reason for their absence in a form of writing with corresponding supporting documents, to be addressed to the Punong Barangay not more than five (5) days after the absence has been incurred. Justification of the absence shall still be upon approval of the Punong Barangay, If no explanation is received or if the absence is deemed invalid, the member shall be subject to a penalty of Php 300.00 payable immediately or deductible from his/her next Honorarium. c. Justified reasons for Absence or Exemption and corresponding supporting documents that need to be presented. i. Confinement at the hospital (present Medical Certificate) ii. Weddings, Baptism (Invitation) iii. Death-immediate family member st nd - For 1 and 2 degree of consanguinity and affinity (will only be excusable form the time of death up to the last day of mourning and burial with a maximum of nine (9) days only. rd th - For 3 and 4 degree of Consanguinity and Affinity (only excusable on the day of burial) iv. Official Travel (no letter or documents to be provided) v. Other special Cricumstance - Sudden sickness that hampers the person to attend the session. d. Tardiness in Session- Every Member of the Sangg unian who will be late without justifiable reason shall be fined: - 15-30 minutes – minutes – Fifty Fifty Pesos - Additional twenty pesos for every succeeding 10 minutes. - More than an hour late will be considered an invalid absence and will have a fine of Php 300.00.

Absences – A A member who incurred absence absen ce as officer of the day without justifiable cause shall be fined with three hundred (Php.300.00) pesos. incu r four (4) consecutive absences as Officer Note: A member who shall incur of the Day shall be fined with his/her one month salary.

A members who comes late during his/her duty shall be fined: 2. Tardiness – A a. Fifty (Php.50.00) for thirty minutes b. Additional twenty (Php.20.00) pesos for more than 30 minutes. Note: Office hours – hours – MONDAY MONDAY TO SUNDAY (8:00 AM- 5:00 PM)

du ring regular/ SECTION 3. ATTIRE- Any member who is not in proper attire during special sessions shall have a fine of One Hundred (Php 100.00) pesos SECTION 4. SMOKING IN SESSION HALL PROHIBITED . – Smoking Smoking shall not be permitted within the session hall. The penalty for the violation of this section shall be a fine of one hundred pesos (Php 100.00).

Drinking any SECTION 5. DRINKING DURING SESSION PROHIBITED . – Drinking intoxicating substance during sessions is prohibited and is punishable by a fine of one hundred pesos (Php 100.00). SECTION 6. GAMBLING IN THE SESSION HALL IS PROHIBITEDgambling at anytime, business or non-business day, is prohibited and punishable by a fine of One hundred pesos (Php 100.00)

recurrence SECTION 7. RECURRENCE OF DIASORDERLY BEHAVIOR. – recurrence of disorderly behavior for four(4) or more times may subject the violating member to censure or suspension provided provided that at least two thirds (2/3) of the Sanggunian Members concur to the action carried out and that the penalty of suspension should not exceed sixty(60) days as mandated in section 50(b) of the Local Government Code. SECTION 8. TRIBUTE FUND – any fees or fines imposed upon the violating member shall be paid immediately or deductible from his/her next honorarium. Collections will serve as Barangay Tribute fund.

RULE VIII. OFFICIAL SEAL

The official seal of the SECTION 1. OFFICIAL SEAL — The Sangguniang Barangay of Cruz shall be of the image of Carabao horns tied to a pole of pine, ornamented with palm leaves and circularly inscribed with the words “Cruz, La Trinidad, Bengu et”

RULE IX. AMENDMENT SECTION 1. AMENDMENTS Any portion of the rules maybe amended provided a request of amendment is provided three (3) days prior to the subsequent regular meeting and the amendment must be concurred by a majority of the Sanggunian members.

EFFECTIVITY

SECTION 1. EFFECTIVITY- These rules shall take effect immediately on the date of their adaption and shall be valid until sooner revoked or amended. th
